End User License Agreement

This End User License Agreement ("Agreement" or "EULA") is a legally binding agreement between you ("User," "you," or "your") and FunSho Media LLC ("ComicTube," "Company," "we," "our," or "us") governing your download, installation, access to, and use of the ComicTube mobile application and related services (collectively, the "App").

By downloading, installing, accessing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not install or use the App.

1. License Grant

Subject to this Agreement, FunSho Media LLC grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download and use ComicTube solely for your personal, non-commercial use on devices you own or control.

This license does not transfer ownership of the App.

2. Eligibility

You must be at least 13 years old, or the minimum legal age required in your jurisdiction, to use ComicTube.

If you are under the required age, you may only use the App with the permission and supervision of a parent or legal guardian.

Certain features, including Adult Mode, are available only to users who are at least 18 years old and have completed any required age verification.

3. User Accounts

Some features require creating an account.

You agree to:

• Provide accurate information.
• Maintain the security of your password.
• Keep your login credentials confidential.
• Accept responsibility for all activity under your account.
• Notify us immediately of unauthorized access.

We reserve the right to suspend or terminate accounts that violate this Agreement.

4. Acceptable Use

You agree not to:

• Violate any applicable law.
• Upload illegal, abusive, defamatory, hateful, threatening, or obscene material.
• Upload malicious software or viruses.
• Attempt to hack, reverse engineer, exploit, or interfere with the App.
• Circumvent security features.
• Impersonate another person.
• Spam other users.
• Use automated bots without authorization.
• Interfere with other users' enjoyment of the App.

Violation of these rules may result in account suspension or permanent termination.

5. User Content

ComicTube allows users to upload videos, audio, images, comments, profiles, and other content.

You retain ownership of your content.

By uploading content, you grant FunSho Media LLC a worldwide, non-exclusive, royalty-free, transferable license to:

• Host
• Store
• Display
• Stream
• Reproduce
• Distribute
• Promote
• Modify (only as reasonably necessary for formatting or platform operation)

This license exists solely for operating, improving, promoting, and providing ComicTube.

You represent that:

• You own the content or have permission to upload it.
• Your content does not violate any law.
• Your content does not infringe intellectual property rights.

6. Comedian Monetization

Eligible comedians may monetize content through subscriptions, tips, or other approved revenue features.

Participation may require:

• Identity verification
• Tax documentation
• A connected Stripe Express account
• Compliance with our Creator Policies

ComicTube reserves the right to determine eligibility and may suspend monetization for policy violations, fraud, abuse, or legal compliance.

7. Premium Subscription

ComicTube may offer optional Premium memberships.

Subscription pricing is displayed before purchase.

Subscriptions automatically renew unless canceled before the renewal date through your App Store or Google Play account.

Cancellation becomes effective at the end of the current billing cycle.

Payments are processed through Apple, Google, Stripe, or other authorized payment providers.

Refunds are governed by the payment platform's policies and applicable law.

8. Adult Content

ComicTube may include optional Adult Mode.

Adult Mode:

• Requires users to be at least 18 years old.
• May require age verification.
• May not be available in all regions.
• Must comply with applicable laws.

Users who bypass age restrictions or upload prohibited adult content may have their accounts terminated.

9. Intellectual Property

ComicTube, its software, branding, logos, trademarks, graphics, interface, code, and design are owned by FunSho Media LLC or its licensors.

Except as expressly permitted, you may not:

• Copy
• Modify
• Sell
• Redistribute
• Reverse engineer
• Create derivative works
• Remove copyright notices

10. Copyright Complaints

If you believe copyrighted material has been posted without authorization, contact: [email protected]

Include:

• Your contact information
• Identification of the copyrighted work
• Location of the alleged infringement
• Good faith statement
• Statement made under penalty of perjury that your claim is accurate

We may remove allegedly infringing material pending investigation.

11. Privacy

Your use of ComicTube is governed by our Privacy Policy.

The Privacy Policy explains:

• Information we collect
• How we use it
• Cookies
• Third-party services
• Security
• Your privacy rights

By using the App, you consent to our Privacy Policy.

12. Third-Party Services

ComicTube may integrate with:

• Stripe
• Apple
• Google
• Social media platforms
• Analytics providers
• Video hosting services
• Advertising providers

These third parties operate under their own terms and privacy policies.

ComicTube is not responsible for third-party services.

13. Updates

ComicTube may automatically download or require software updates.

Updates may:

• Improve security
• Fix bugs
• Add features
• Remove features
• Improve compatibility

Continued use of the App after updates constitutes acceptance of the revised software.

14. App Availability

We strive to provide uninterrupted service but do not guarantee that the App will always be available.

The App may be unavailable due to:

• Maintenance
• Security updates
• Technical failures
• Internet outages
• Third-party provider interruptions

15. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNSHO MEDIA LLC DISCLAIMS ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY
• RELIABILITY
• CONTINUOUS AVAILABILITY

We do not guarantee that the App will be error-free or uninterrupted.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNSHO MEDIA LLC SHALL NOT BE LIABLE FOR:

• Lost profits
• Lost revenue
• Lost data
• Business interruption
• Indirect damages
• Incidental damages
• Special damages
• Consequential damages
• Punitive damages

Our total liability shall not exceed the amount you paid to ComicTube during the twelve (12) months preceding the claim.

Some jurisdictions do not allow certain liability limitations, so portions of this section may not apply.

17. Indemnification

You agree to defend, indemnify, and hold harmless FunSho Media LLC, its officers, employees, affiliates, contractors, and licensors from any claims arising from:

• Your use of the App.
• Your uploaded content.
• Your violation of this Agreement.
• Your violation of another person's rights.

18. Suspension and Termination

We may suspend or terminate your account at any time if you:

• Violate this Agreement.
• Engage in fraud.
• Abuse other users.
• Upload prohibited content.
• Threaten the security of the platform.
• Violate applicable law.

Termination may include deletion of your account and content where permitted by law.

19. Changes to this Agreement

We may modify this Agreement at any time.

Updated versions become effective upon posting within the App or on ComicTube.app.

Continued use after changes constitutes acceptance.

20. Governing Law

This Agreement shall be governed by the laws of the State of California, United States, without regard to conflict of law principles.

21. Severability

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

22. Entire Agreement

This Agreement, together with our:

• Privacy Policy
• Terms and Conditions
• Community Guidelines
• Creator Policies
• Any additional policies incorporated by reference

constitutes the entire agreement between you and FunSho Media LLC regarding the App.

23. Apple App Store Additional Terms

If you downloaded ComicTube from the Apple App Store:

• This Agreement is between you and FunSho Media LLC, not Apple.
• Apple has no obligation to provide maintenance or support.
• Apple is not responsible for claims relating to the App.
• Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce its terms.
• Your use of the App must comply with the Apple Media Services Terms and Conditions.

24. Google Play Additional Terms

If downloaded from Google Play:

• Your use of the App must comply with Google Play policies.
• Google is not responsible for maintenance or support.
• Google has no liability relating to the App except as required by law.
